Positive duties in International Law: Obligations of States, Organizations of States, Organizations and Persons.

This project seeks to determine the existence and use of positive duties of states in international law. Scanning the international legal regimes of human rights, humanitarian, diplomatic, environmental, public health, and criminal law, the researchers will determine the extent to which they are used, and how such duties are structured. Using the background analysis, the project members will then see whether positive duties found in international economic law are similarly structured. If the result is that they are not, suggestions will be made as to whether or how to make the systems more compatible. A final stage of the project will examine the role of positive duties on non-state actors in international law. Rules affecting international organizations and non-governmental organizations (profit and non-for profit actors) will be the target of this portion of the study.
